FABFITFUN – ADDITIONAL CANCELLATION, RETURN AND REFUND RIGHTS (APPLICABLE ONLY TO CUSTOMERS IN THE UNITED KINGDOM (“UK”) WHO ARE CONSUMERS)

SECTION ONE: deals with your right to cancel an order for a Seasonal or Annual FabFitFun subscription.

SECTION TWO: deals with your right to cancel an order for products purchased in FabFitFun’s Sales, through FabFitFun’s Shop, or through sites owned by FabFitFun (“FabFitFun Products”).

SECTION THREE: deals with your right to return faulty/defective items under the Consumer Rights Act 2015.

SECTION ONE: CANCELLING AN ORDER FOR A SUBSCRIPTION

Cancelling an order for a Seasonal or Annual Subscription

In accordance with the Consumer Contracts Regulations 2013, you are entitled to cancel your order for a Seasonal or Annual Subscription by notifying us of your intention to do so within fourteen (14) days of delivery of your first Box and by returning that Box to FabFitFun in accordance with this section.

Each Seasonal or Annual Subscription is for these purposes a single order forming part of a regular delivery of goods, so you can only cancel a Seasonal or Annual Subscription and receive a refund within fourteen days of receiving your first box. You can of course cancel your subscription at any time, but it is only if you do it within this initial fourteen day period after you receive your first Box that you will be entitled to a refund (as required by UK legislation known as the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013).

To exercise your cancellation rights and return a Box to FabFitFun, please follow the steps below.

Step 1.

Within fourteen (14) days of delivery of your Box, either (a) contact our Customer Care Team at vip@fabfitfun.com or by calling 001 855-313-6267 during regular business hours (Monday-Sunday 4:00am to 12:00am PST) or (b) fill out a cancellation form available here and send back to us at vip@fabfitfun.com.

Step 2.

Return the Box. You are responsible for returning the Box to us as soon as possible. Unless the Box is faulty, you will be required to arrange and pay for the cost of returning it to us. To return the Box, you must:

Please ensure that you obtain a proof of postage and provide us with the tracking number as we do not accept responsibility for items which are lost in transit. Customers should make note of any labelling and packaging guidelines produced by Royal Mail or any other courier used.

The Box must be returned unused, with authentic labels and in original packaging. Your right to return a Box does not apply where sealed goods have been supplied which are not suitable for return due to health protection or hygiene reasons, if they become unsealed after delivery.

Step 3.

The Box will be examined by FabFitFun upon receipt. We will not provide a full refund if the Box show signs of unreasonable use. In such circumstances, we will notify you that a reduced refund amount, if any, will be available or you can choose to arrange for the Box to be returned to you within twenty eight (28) days of our notification.

Your payment for the individual Seasonal or Annual Subscription (including the initial standard delivery charge, but not the additional cost of any premium delivery option that was chosen) will be refunded by FabFitFun as soon as possible by the original payment method, no later than: (1) fourteen (14) days after we have received the Box from you (provided that you have returned it to us within fourteen (14) days of delivery to you); or (2) (if earlier) 14 days after you provide evidence that you have returned the Box to us.

If we refund you the price paid before we are able to inspect the Box and later discover that you have handled it in an unacceptable way, you will be liable to pay to us an appropriate amount.

If you cancel your order for a Seasonal or Annual Subscription and return the Box to us in accordance with this section, you will not receive or be charged for any further Boxes.

SECTION TWO: CANCELLING AN ORDER FOR PRODUCTS PURCHASED IN FABFITFUN’S SALES, THROUGH FABFITFUN’S SHOP, OR SITES OWNED BY FABFITFUN (“FABFITFUN PRODUCTS”)

As you are a consumer you may, in accordance with the Consumer Contracts Regulations 2013, cancel an order for FabFitFun Products within fourteen (14) days from delivery and obtain a refund. You can choose to cancel your entire order of FabFitFun Products or part of your order if you wish to keep some of the items you ordered.

To exercise your cancellation rights and return FabFitFun Product(s) to FabFitFun, please follow the 3 steps below.

Step 1.

Within fourteen (14) days of delivery of your FabFitFun Products, either (a) contact our Customer Care Team at vip@fabfitfun.com or by calling 001 855-313-6267 during regular business hours (Monday-Sunday 4:00am to 12:00am PST) or (b) fill out a cancellation form available here and send back to us at vip@fabfitfun.com.

Step 2.

Return the FabFitFun Products. For those FabFitFun Product(s) you wish to return, you are responsible for returning the Product(s) to us as soon as possible. Unless the Product(s) you are returning is or are faulty, you will be required to arrange and pay for the cost of returning such Product(s). To return the FabFitFun Product(s), you must:

SECTION THREE: CONSUMER RIGHTS ACT 2015

The Consumer Rights Act 2015 states that goods delivered to you must be in conformity with your contract, as described, fit for purpose and of satisfactory quality. You may be entitled to a refund if the Products do not meet these requirements.
